1. EPSON REWARDS PROGRAM

1.1 The Epson Rewards benefits program is a program designed to reward you for using original Epson products with your SureColor F-Series printer. By signing up for the program, you can earn points when purchasing and using Epson ink or paper purchased through authorized retailers and and by registering your printer. Points can be exchanged when purchasing extended services for your registered printer or for other F-Series printers. The Epson Rewards benefits program is an exciting program with great benefits!

1.2 Remember, SureColor F-Series printers are designed for use only with Epson ink cartridges and refills, and no other brand new or refilled cartridge or other ink brands or bulk ink systems.

 

2. ENROLLMENT IN THE PROGRAM

2.1. Visit the Epson Rewards website: https://epsonrewards.com

2.2. Create a user account and password or enter your information if you are already subscribed. You must also register the serial number on the general product registration page as well as the any other software required by Epson including but not limited to PORT software.

2.3. Look for the Epson Rewards label on the packaging of participating ink and paper.

2.4. Discover the seal to reveal the secret code that allows you to start earning points.

2.5. Enter the necessary information on the website.

2.6. You are already earning points with SureColor F-Series Rewards!

2.7. Models SC-F10070, SC-F10070H, SC-F3070, SC-F6470, SC-F6470H, get points automatically added from ink monthly consumption as reported by PORT system and after verification of purchase with an authorized reseller. Registration to Port and consistent connection to the cloud are required for all printers.

 

3. AWARDS

3.1. With each ink or participating media pack you purchase, you earn valuable points that can be used to exchange prizes. See these tables below to see how many points you earn with each product and check out what prizes you can get with your points.

* Discounts are on the suggested price to the consumer of the product or service at the time the points are exchanged. The suggested price to the consumer may change from time to time without notice.

** Service agreements are only available for F-Series printers registered with the Benefits Program during the first 12 months of the original product purchase. Continuous coverage under the Epson Preferred Plus (no lapse) plan is also required. The service contract must be purchased prior to the expiration of your current service term (or first year of the original limited warranty). The maximum number of service agreements that can be purchased for any printer is two (a total of 2 years of service after the expiration of the first year of the printer's standard limited warranty), with the exception of SureColor® F570/F571. The maximum number of service contracts that can be purchased for the F570/F571 is one (a total of one year of service after the first year of the printer's standard limited warranty expires). Discounts for Service agreements are not available in Colombia.

4. POINTS REDEMPTION

4.1. Visit the Epson Rewards website.

4.2. Enter your username and password.

4.3. Check your points balance.

4.4. Redeem your points for discounts on new printers or extension of service agreements.

 

5. TERMS AND CONDITIONS

5.1. To enroll in the Epson Rewards benefits program and participate to earn points, your F-Series printer must be registered on the Epson website.

5.4. PLEASE READ THIS IMPORTANT INFORMATION ABOUT HOW EPSON WILL COMMUNICATE WITH YOU: When you register to participate in the benefits program, you must provide us with your email address. Epson will use it to communicate with you about the program (e.g., in confirming points earned or exchanged), and to send you marketing and promotional messages about Epson. You consent to receive such messages from Epson. You may opt out of receiving marketing and promotional messages via the link provided in the email message or by sending an email to Epson at emails listed below, telling us that you have chosen not to receive those messages. The subject of the email should contain "Request to stop receiving marketing messages". However, you may not choose to receive transactional messages related to your participation in the program. 5.2. Except as mentioned in the next paragraph, Epson reserves the right to change, cancel and modify the conditions and/or to cancel, in part or in its entirety, the Epson Rewards benefit program at any time, with or without prior notice to participants. This may include reducing the number of points redeemed in purchases or increasing the number of points required for discounts on products and services. In addition, Epson may delete, limit or investigate a participant or cancel unexchanged points if there is a suspicion of fraud in the purchase or use of Epson products or abuse of the benefits program or violation of its terms. Some examples of fraudulent actions:

5.3.1. Trade in products purchased at a discount.

5.3.2. Trade in Epson Rewards codes.

5.3.3. Exchange of points between customers.

5.3. If Epson identifies that the terms of this Regulation are not being complied with as set out above, the notification process begins:

5.4.1. Step 1: An Epson sales representative will contact you by email or telephone to request the adjustment to the regulation under the above terms.

5.4.2. Step 2: If the infringement is not addressed within 24 hours, Epson will send a formal notification to the customer.

5.4. If after 24 hours of sending the notification mentioned above the violation of the Regulation is not addressed, the customer will be suspended from the Program for a period of 30 days.

5.5. If the customer is a repeat offender in the violations of these Regulations, he may be suspended as a Definitive Program Participant and may lose the total balance of points accumulated in the Program.

5.6. The points are valid until December 31 of the calendar year following the registration of the points. For example, when you purchase participating inks and register them on November 30 of a year, these redeemed points will be valid until December 31 of the following year.

5.7. The exchange of points for a new F-Series printer is limited by the availability of the devices. Epson cannot guarantee the immediate availability of the products.

5.8. Points can only be redeemed by the owner of the F-Series printer. The points are connected to the printer and the serial number that have been registered. Points are non-transferable.

5.9. Points cannot be exchanged for cash or its equivalent under any conditions. Points can only be exchanged for discounts on products and services described in this summary document and program terms.

5.10. Points and rewards purchased through the Epson Rewards program cannot be combined with any other promotional offer when purchasing an Epson product.

5.11. Taxes due on the purchase of a specific new product or a service with the use of points are the sole responsibility of the program participant.

5.12. Points are exchanged for discounts on certain products or services. Discounts are on the price of the Epson product or service suggested to the consumer at the time of the exchange of points. The suggested price to the consumer may change from time to time without notice.

5.13. Epson reserves the right to reduce the participant's points based on refunds or credits for products with which the points were redeemed.

5.14. If your account is cancelled or the program is cancelled for any reason, program access will be cancelled and all points that have not yet been exchanged will be lost. In addition, points will be cancelled on the expiration date of the points or for any violation of these terms.

5.15. The program is invalid where prohibited by law. Rewards may not be valid where prohibited by law.

5.16. You may cancel your program subscription at any time by contacting Epson by email to:

5.17. Epson reserves the right to terminate or amend the Benefits Program, including the right to modify the procedure and requirements for redemption of points, at any time.

5.18. 6. DATA DELETION; MAXIMUM RESPONSIBILITY OF EPSON

6.1. Neither Epson nor its affiliates shall be liable for any loss, inconvenience or damage, including direct, special, incidental or consequential damages, including loss of profits, equipment replacement cost, downtime, third party requests, including customers, or property damage, resulting from the use or inability to use Epson products, whether resulting from a breach of warranty or any other legal theory. Some competencies do not allow limits on guarantees or break-ins in certain transactions. In such powers, the limits in this paragraph and in the preceding paragraph may not apply.

 

7. DISPUTES, ARBITRATION, LAWS IN FORCE

7.1. You and Epson agree that any dispute or request arising out of, or relating to, Epson's products or services or this agreement, will be resolved in arbitration on an individual, non-collective or representative basis, and not in court. Arbitration shall be governed by jams rules that are in effect when arbitration is filed, excluding any rules that allow arbitration on a collective or representative basis, under the rules set forth in this agreement. The arbitrator, and not any federal, state or local court or body, shall have exclusive authority to resolve any dispute relating to interpretation, applicability, enforceability or training, including, without limitation, any claim that all or party is void or void. JAMS rules are available at https://www.jamsadr.com/ about/ or by calling +1-949-224-1810 (from outside the United States) or 1-800-352-5267 (from within the United States). A single neutral arbitrator will resolve disputes, and both parties will have a reasonable opportunity to participate in the referee's selection. The arbitrator is obliged to follow the terms of this agreement.

7.2. Notification and Pre-Arbitration Steps. Before filing an arbitration request, you agree to attempt, for sixty (60) days, to resolve any dispute informally by contacting us at customer.inquires@ea.epson.com. Include your name, address and contact information, the facts generating the dispute and the compensation requested. You agree to act in good faith to resolve the dispute, but if you and Epson do not reach a settlement within sixty (60) days, you may initiate an arbitration.

7.3. No Participation. You may choose not to participate (exclude yourself) in the individual, binding, final and repudiation arbitration proceedings specified in this agreement by sending a written letter to Epson America, Inc., ATTN: Legal Department, 3131 Katella Avenue Los Alamitos, CA 90720, within thirty (30) days of your purchase of your Epson products and/or services which specifies (i) your name, (ii) your mailing address, and (iii) your request to be excluded from the individual, binding, final and repudiation arbitration process of class and representative actions specified in this Section B. In the event that the User does not participate consistent with the procedure set out above, all other conditions shall continue to apply, including the requirement to provide notice of dispute.

7.4. No jury or judge in arbitration and grounds for recurrence are limited, however, the arbitrator has the power to grant any redress that would be available in a court, including injunction or declarative action. Arbitration compensation judgment may be filed in any competent court.

7.5. Notwithstanding the foregoing, you may file an individual action in a small-cause court in your state or municipality if the action is the jurisdiction of the court and pending only in that court.

7.6. Notwithstanding the foregoing, we both also agree that you or we may take action to the court to prohibit infringement or other improper use of intellectual property rights.

7.7. Any share must be deposited within one (1) year of maturity or termination of the guarantee.

7.8. If any provision in this Section 7 is unenforceable, such provision shall be purged with the remainder of this agreement remaining in full effect. The precedent shall not apply to the prohibition against collective, consolidated or representative actions. That means if Section 7. 9th. (below) is unenforceable, the entire Section 7 (but only section 7) will be null and void.

7.9. You and Epson agree that any dispute resolution hearings will be conducted only individually and not in a class action, consolidated or representative.

7.10. This Section 7 is governed by the Federal Arbitration Act.

 

8. OTHER PROVISIONS

8.1. Governing Laws: Except for Disputes subject to arbitration in accordance with the terms of Section 7, you and Epson agree that the law of the State or Country in which you reside will govern.

8.2. Jurisdiction: Except for Disputes subject to arbitration under the terms of Section B, in the case of a Dispute in which you and Epson both accept the laws of your jurisdiction in your home state if you do not reside in a State, then the laws of the jurisdiction of Los Angeles County, California.

 

VIP Program Regulation:

1. THEEPSON REWARDS VIP PROGRAM

1.1. The VIP Program offers discounts for the purchase of original inks for the equipment of the F-Series and Series-S lines. Discounts vary depending on the average monthly consumption of customer inks and the proper release of points on the platform.

 

2. PROGRAM ENROLLMENT

2.1. To access the benefits of the VIP program the customer must be properly registered in the Epson Rewards program, register the codes acquired when purchasing original Epson products and consume the minimum volume of ink required for each program categories.

 

3. CATEGORIZATION, CRITERIA AND DISCOUNT

3.1. Validation is done according to the registration of codes on the Epson Rewards website and when reaching the number of rewards codes and volume of inks required, the customer will be included in one of the categories below, considering the average ink consumption and the release of codes in the last 6 months:

3.2. Customers will undergo a revalidation at the close of each semester, where they can go up or down in category. The review months are January and July.

3.3. There will be no category change during the period already approved, any change will occur only in the periods described above.

3.4. Price changes should always be practiced 1 day after updating the new VIP scenario.

3.5. Until the upgrade is made, the discounts for the previous quarter remain.

3.6. New customers may join the program at any time but must meet the criteria of item 2 and go through the revalidations described in item 3.

3.7. The discount mentioned above is linked to proof of purchase forwarded by the Epson Partner Channel (Sales NF).

3.8. Quantities and calculation periods may change without notice.

3.9. The application of the VIP Program discount will be released only to the channel that sold equipment to the customer, upon proof of sale (sale NF).

 

 

4. COMPLIANCE WITH THIS REGULATION

4.1. Epson may make visits without notice to the customer, to validate the consumption of ink.

4.2. Epson has tools for measuring and monitoring customers' ink consumption. Epson may request the installation of this tool to validate the actual consumption of printers.

4.3. Customers participating in the VIP program cannot sell, donate, or subsidize other customers with the inks they have purchased at a discount.

4.4. Purchase group formation is not allowed to enter or climb the VIP Program.

4.5. You may not purchase or sell Epson Rewards codes.

4.6. If Epson identifies that the terms of this Regulation are not being complied with as set out above, the notification process begins:

a. Step 1: An Epson sales representative will contact you via email or telephone to request the adjustment to the regulation under the above terms.

b. Step 2: If the infringement is not addressed within 24 hours, Epson will send a formal notification to the customer.

4.7. If after 24 hours of sending the notification mentioned above the violation of the Regulation is not addressed, the customer will be suspended from the Program for a period of 30 days.

4.8. If the customer is a repeat offender in the violations of these Regulations, he may be suspended as a Definitive Program Participant and may lose the total balance of points accumulated in the Program.

 

5. GENERAL CONDITIONS

5.1. In the event of counterfeiting, fraud, product returns or cancellation of sales made, the owners or responsible for the Resales will have automatically cancelled all their benefits obtained in any of the hypotheses described herein.

5.2. Epson reserves the right to invalidate the benefits improperly accumulated by customers in the event of failures or breakdowns in the Program System or Equipment.

5.3. Epson reserves the right at any time to terminate the VIP Program upon prior notice. It is now established that there will be no refund from Epson.

5.4. This Regulation may be replaced or amended at any time at Epson's sole and exclusive discretion.

5.5. Points can only be redeemed by the printer owner. The points are connected to the printer and the serial number that have been registered. Points are non-transferable;

Jurisdiction: Except for Disputes subject to arbitration under the terms of Section B, in the case of a Dispute in which you and Epson both accept the laws of your jurisdiction in your home state if you do not reside in a State, then the laws of the jurisdiction of Los Angeles County, California.

9. TERMS AND CONDITIONS

9.4. To enroll in the Epson Rewards benefits program and participate to earn points, your S-Series printer must be registered on the Epson website.

9.5. PLEASE READ THIS IMPORTANT INFORMATION ABOUT HOW EPSON WILL COMMUNICATE WITH YOU: When you register to participate in the benefits program, you must provide us with your email address. Epson will use it to communicate with you about the program (e.g. in confirming points earned or exchanged), and to send you marketing and promotional messages about Epson. You consent to receive such messages from Epson. You may opt out of receiving marketing and promotional messages via the link provided in the email message or by sending an email to Epson at the emails below, telling us that you have chosen not to receive those messages. The subject of the email should contain "Request to stop receiving marketing messages". However, you may choose not to receive transactional messages related to your participation in the program. 9.6. Except as mentioned in the next paragraph, Epson reserves the right to change, cancel and modify the conditions and/or to cancel, in part or in its entirety, the Epson Rewards benefit program at any time, with prior notice to participants. This may include reducing the number of points redeemed in purchases or increasing the number of points required for discounts on products and services. In addition, Epson may delete, limit or investigate a participant or cancel unexchanged points if there is a suspicion of fraud in the purchase or use of Epson products or abuse of the benefits program or violation of its terms. Some examples of fraudulent actions:

1. Trade in products purchased at a discount.

2. Trade in Epson Rewards Codes.

3. Exchange of points between customers.

9.7. If Epson identifies that the terms of this Regulation are not being complied with as set out above, the notification process begins:

1. Step 1: An Epson sales representative will contact you via email or telephone to request the adjustment to the regulation under the above terms.

2. Step 2: If the infringement is not addressed within 24 hours, Epson will send a formal notification to the customer.

9.8. If after 24 hours of sending the notification mentioned above the violation of the Regulation is not addressed, the customer will be suspended from the Program for a period of 30 days.

9.9. If the customer is a repeat offender in the violations of these Regulations, he may be suspended as a Definitive Program Participant and may lose the total balance of points accumulated in the Program.

9.10. The points are valid until December 31 of the calendar year following the registration of the points. For example, when you purchase participating inks and register them on November 30 of a year, these redeemed points will be valid until December 31 of the following year.

9.11. The exchange of points for a new S-Series printer is limited by the availability of the devices. Epson cannot guarantee the immediate availability of the products.

9.12. Points can only be redeemed by the owner of the S-Series printer. The points are connected to the printer and the serial number that have been registered. Points are non-transferable.

9.13. Points cannot be exchanged for cash or its equivalent under any conditions. Points can only be exchanged for discounts on products and services described in this summary document and program terms.

9.14. Points and rewards purchased through the Epson Rewards program cannot be combined with any other promotional offer when purchasing an Epson product.

9.15. Taxes due on the purchase of a specific new product or a service with the use of points are the sole responsibility of the program participant.

9.16. Points are exchanged for discounts on certain products or services. Discounts are on the price of the Epson product or service suggested to the consumer at the time of the exchange of points. The suggested price to the consumer may change from time to time without notice.

9.17. Epson reserves the right to reduce the participant's points based on refunds or credits for products with which the points were redeemed.

9.18. If your account is cancelled or the program is cancelled for any reason, program access will be cancelled and all points that have not yet been exchanged will be lost. In addition, points will be cancelled on the expiration date of the points or for any violation of these terms.

9.19. The program is invalid where prohibited by law. Rewards may not be valid where prohibited by law.

9.21. Epson reserves the right to terminate or amend the Benefits Program, including the right to modify the procedure and requirements for redemption of points, at any time;

10. DATA DELETION; MAXIMUM RESPONSIBILITY OF EPSON

10.4. Neither Epson nor its affiliates shall be liable for any loss, inconvenience, or damage, including direct, special, incidental or consequential damages, including loss of profits, equipment replacement cost, downtime, third party requests, including customers, or property damage, resulting from the use or inability to use Epson products, whether resulting from a breach of warranty or any other legal theory. Some competencies do not allow limits on guarantees or break-ins in certain transactions. In such powers, the limits in this paragraph and in the preceding paragraph may not apply.

 

11. DISPUTES, ARBITRATION, LAWS IN FORCE

11.4. You and Epson agree that any dispute or request arising out of, or relating to, Epson's products or services or this agreement, will be resolved in arbitration on an individual, non-collective or representative basis, and not in court. Arbitration shall be governed by jams rules that are in effect when arbitration is filed, excluding any rules that allow arbitration on a collective or representative basis, under the rules set forth in this agreement. The arbitrator, and not any federal, state or local court or body, shall have exclusive authority to resolve any dispute relating to interpretation, applicability, enforceability or training, including, without limitation, any claim that all or party is void or void. A single neutral arbitrator will resolve disputes, and both parties will have a reasonable opportunity to participate in the referee's selection. The arbitrator is obliged to follow the terms of this agreement.

11.5. Notification and Pre-Arbitration Steps. Before filing an arbitration request, you agree to attempt, for sixty (60) days, to resolve any dispute informally by contacting us at customer.inquires@ea.epson.com. Include your name, address and contact information, the facts generating the dispute and the compensation requested. You agree to act in good faith to resolve the dispute, but if you and Epson do not reach a settlement within sixty (60) days, you may initiate an arbitration.

11.6. No Participation. You may choose not to participate (exclude yourself) in the individual, binding, final and repudiation arbitration proceedings specified in this agreement by sending a written letter to Epson America, Inc., ATTN: Legal Department, 3131 Katella Avenue Los Alamitos, CA 90720, within thirty (30) days of your purchase of your Epson products and/or services which specifies (i) your name, (ii) your mailing address, and (iii) your request to be excluded from the individual, binding, final and repudiation arbitration process of class and representative actions specified in this Section B. In the event that the User does not participate consistent with the procedure set out above, all other conditions shall continue to apply, including the requirement to provide notice of dispute.

11.7. No jury or judge in arbitration and grounds for recurrence are limited, however, the arbitrator has the power to grant any redress that would be available in a court, including injunction or declarative action. Arbitration compensation judgment may be filed in any competent court.

11.8. Notwithstanding the foregoing, you may file an individual action in a small-cause court in your state or municipality if the action is the jurisdiction of the court and pending only in that court.

11.9. Notwithstanding the foregoing, we both also agree that you or we may take action to the court to prohibit infringement or other improper use of intellectual property rights.

11.10. Any share must be deposited within one (1) year of maturity or termination of the guarantee.

11.11. If any provision in this Section 7 is unenforceable, such provision shall be purged with the remainder of this agreement remaining in full effect. The precedent shall not apply to the prohibition against collective, consolidated or representative actions. That means if Section 7. 9th. (below) is unenforceable, the entire Section 7 (but only section 7) will be null and void.

11.12. You and Epson agree that any dispute resolution hearings will be conducted only individually and not in a class action, consolidated or representative.

11.13. This Section 7 is governed by the Federal Arbitration Act.

 

12. OTHER PROVISIONS

12.4. Governing Laws: Except for Disputes subject to arbitration in accordance with the terms of Section 7, you and Epson agree that the law of the State or Country in which you reside will govern.

12.5. Jurisdiction: Except for Disputes subject to arbitration under the terms of Section B, in the case of a Dispute in which you and Epson both accept the laws of your jurisdiction in your home state if you do not reside in a State, then the laws of the jurisdiction of Los Angeles County, California.

 

VIP Program Rewards Series S Regulation:

1. THE EPSON REWARS VIP PROGRAM

1.1. The VIP Program offers discounts for the purchase of original inks of the equipment of the F-Series and Series-S lines. Discounts vary depending on the average monthly consumption of customer inks and the proper release of points on the platform.

 

2. PROGRAM ENROLLMENT

2.1. To access the benefits of the VIP program the customer must be properly registered in the Epson Rewards program, register the codes acquired when purchasing original Epson products and consume the minimum volume of ink required for each of the program categories.

 

3. CATEGORIZATION, CRITERIA AND DISCOUNT

3.1. Validation is done according to the registration of codes on the Epson Rewards website and when reaching the number of rewards codes and volume of inks required, the customer will be included in one of the categories below, considering the average ink consumption and the release of codes in the last 6 months:

3.2. Customers will undergo a revalidation at the close of each semester, where they can go up or down in category. The review months are January and July.

3.3. There will be no category change during the period already approved, any change will occur only in the periods described above.

3.4. Price changes should always be practiced 1 day after updating the new VIP scenario.

3.5. Until the upgrade is made, the discounts for the previous quarter remain.

3.6. New customers may join the program at any time but must meet the criteria of item 2 and go through the revalidations described in item 3.

3.7. The discount mentioned above is linked to proof of purchase forwarded by the Epson Partner Channel (Sales NF).

3.8. Quantities and calculation periods may change without notice.

3.9. The application of the VIP Program discount will be released only to the channel that sold equipment to the customer, upon proof of sale (sale NF).

 

4. COMPLIANCE WITH THIS REGULATION

4.1. Epson may make visits without notice to the customer, to validate the consumption of ink.

4.2. Epson has tools for measuring and monitoring customers' ink consumption. Epson may request the installation of this tool to validate the actual consumption of printers.

4.3. Customers participating in the VIP program cannot sell, donate, or subsidize other customers with the inks they have purchased at a discount.

4.4. Purchase group formation is not allowed to enter or climb the VIP Program.

4.5. You may not purchase or sell Epson Rewards codes.

4.6. If Epson identifies that the terms of this Regulation are not being complied with as set out above, the notification process begins:

a. Step 1: An Epson sales representative will contact you via email or telephone to request the adjustment to the regulation under the above terms.

b. Step 2: If the infringement is not addressed within 24hours, Epson will send a formal notification to the customer.

4.7. If after 24 hours of sending the notification mentioned above the violation of the Regulation is not addressed, the customer will be suspended from the Program for a period of 30 days.

4.8. If the customer is a repeat offender in the violations of these Regulations, he may be suspended as a Definitive Program Participant and may lose the total balance of points accumulated in the Program.

 

5. GENERAL CONDITIONS

5.1. In the event of counterfeiting, fraud, product returns or cancellation of sales made, the owners or responsible for the Resales will have automatically cancelled all their benefits obtained in any of the hypotheses described herein.

5.2. Epson reserves the right to invalidate the benefits improperly accumulated by customers in the event of failures or breakdowns in the Program System or Equipment.

5.3. Epson reserves the right at any time to terminate the VIP Program upon prior notice. It is now established that there will be no refund from Epson.

5.4. This Regulation may be replaced or amended at any time at Epson's sole and exclusive discretion.
